Question:
In the case of a dispute during a property transaction, in Dubai, where one party wishes to back out; how legally binding is an MOU which was signed via email? i.e.: signed, scanned, sent to 2nd party, printed, signed, scanned again and sent back. I’ve been told that such an MOU is binding but by others that it is not. My own research leads me to believe the latter but I can’t be sure.
Thank you.
Answer:
To determine the validity and binding nature of the MoU, we need to first review the document in light of the applicable UAE laws. Please let us know if you are able to send the copy of MoU.
