I am trying to get a divorce from my husband, however, he refuses to divorce me. Is there any way around it or am I stuck? I Have been to Dubai courts five times but my husband refuses to join me so they keep sending me back saying I need to bring him. I have good grounds for divorce, my husband had a job in 2 years and sleeps with other woman and beats me. I am the sole provider for our family. We have a 10-month-old daughter. I also financially support his entire family.
Answer: As per the UAE personal status law, it is the husband’s duty to take care of the wife and children. If your husband has not complied with the law as required you have the right to file for divorce based on that ground.
The issue of physical harm would need to substantiate by medical evidence or witnesses to be used as a ground for divorce. Even if he refuses to cooperate you still have the right to get divorced from him by filing a case at the family guidance center of the Dubai Family court.
In order to make sure that you are aware of your rights in regards to financial alimony and child custody, it is advisable that you seek professional legal advice prior to filing the case at the court.
