This landmark Dubai case demonstrates, how UAE courts ensure comprehensive protection, for the
families devastated, by fatal traffic accidents, combining statutory blood money, with additional
civil damages.
UAE courts awarded Dh496,429 total compensation: including Dh200,000 blood
money, plus moral damages, establishing that families, can claim beyond statutory minimums, when
losing their sole breadwinner.
Insurance companies cannot escape liability: even when drivers violate multiple
traffic laws, UAE Federal Decree-Law No. 48/2023 legally binds insurers, to compensate third
parties for death, or bodily injury, without limits on judicially awarded values.
Families have clear legal recourse: through SANADAK (Central Bank's free
dispute resolution center) and courts, which typically favor policyholders in motor insurance
cases where swift action is required by law.
Multiple violations compounded this tragedy: the driver at fault was speeding,
driving against the flow of traffic and driving an unregistered vehicle. All of these factors
weigh heavily with the courts in determining negligence and levels of compensation.
This case highlights the importance of having a qualified lawyer for compensation claims, as
insurance companies will always try to avoid responsibility at the beginning, even if you are in the
right according to UAE traffic and insurance laws.

Introduction
Dubai authorities conducted inquiries into a fatal car
accident, which resulted in a landmark compensation award of Dh500,000 to the family of the
victim. The tragic incident happened when a motorist drove against traffic flow in Al Dhafra and
lost control because of speeding, resulting in a head-on collision that claimed the life of an
Indian national. The victim, who was critically injured and died days after being hospitalized, he
was the sole breadwinner for his parents, wife and two daughters. This car accident report Dubai
courts reviewed, showed the devastated financial impact on the family left with no income. The legal
process was a battle with the insurance company, which ultimately resulted in the substantial
payout. It is very important to obtain the proper legal representation to understand the car
accident history in Dubai. Often the family who has been affected by such tragedies require the best
legal consultant in Dubai to provide representation for their compensation claims.
Fatal Head-On Collision Claims Indian National's Life
The unnamed Emirati motorist drove his vehicle against the flow of traffic in Al Dhafra, creating a
dangerous situation, that quickly spiraled out of control. Police reports confirmed the driver was
speeding, when he lost control of the vehicle, which did not belong to him. During the collision, he
struck the Indian victim's car head-on, forcing it to veer off the road.
The impact caused the victims’ vehicle to flip over trapping him in the vehicle with serious
injuries. He was taken to a nearby hospital where medical teams are working to stabilize his
condition. Despite their efforts, the victim died days later from his injuries.
The tragedy had profound impacts on the victim’s family. He was the only breadwinner, for his
parents, wife and two daughters. His death immediately made the family financially unstable, with no
source of income to meet their day-to-day needs.
Investigators determined the Emirati driver bore sole responsibility for the accident. Besides
speeding, and driving against traffic, he operated a vehicle that was not registered in his name.
The police findings highlighted the various traffic violations that directly resulted in the fatal
outcome. The car accident report compiled, by Dubai authorities, became the central focus of the
subsequent legal proceedings, to establish clear liability for the collision, and its devastating
impact on the victim’s family.
Legal Battle Against Insurance Company Begins
Following the fatal collision, the victim's family filed, a lawsuit, against the at fault
driver's insurance company, demanding compensation, according to Article 26 of Traffic Law
21/1995. The insurance firm filed a memorandum seeking the dismissal of the claim, saying it had no
liability for damages caused by the speeding motorist.
UAE insurance laws set out clear responsibilities for insurers in the event of motor vehicle
accidents. The insurance companies are legally bound to pay policyholders, or beneficiaries, with
Federal Decree-Law No. 48/2023 requiring claims to be settled within a reasonable period. In cases
of death or bodily injury, the rules of the Central Bank require insurers to pay injured third
parties without any limit regarding the values awarded by the court. The maximum compensation for
deaths is Dh200,000 for each deceased.
The legal framework provides, multiple avenues for disputing rejected claims. Policyholders can lodge
complaints with the Central Bank, which supervises insurance companies and imposes penalties for
non-compliance. The Central Bank has also set up a dispute resolution center called SANADAK. This is
a mandatory step in most insurance disputes and an adjudication by SANADAK is free and usually takes
four to twelve weeks to resolve.
In the UAE, courts frequently rule in favor of the policyholder in motor insurance cases where the
law requires prompt action. The victim's family pursued their case through the formal legal
system seeking compensation for the loss of their only breadwinner.
Abu Dhabi Court Awards Dh500,000 Compensation
The Abu Dhabi Court of First Instance ruled in favour of the victim’s family and ordered the
insurance company to pay a total of Dh496,429 in compensation. The court relied on UAE legal
principles governing fatal traffic accidents which recognize both statutory blood
money and additional civil damages.
In the case of death resulting from unlawful acts, courts can order the payment of AED 200,000 as
Diya (blood money) to the heirs of the victim, according to Article 30 of the UAE Penal Code. The
same amount applies to both genders. In reality, this statutory compensation serves as the baseline
for the fatal accident cases.
The court acknowledged that, blood money alone does not stop relatives, from seeking further damages.
According to Dubai Court of Cassation Case No. 111/2020, compensation for moral damages could be
awarded in addition to the Diya. The court ruled that the parents’ grief and emotional suffering
resulting from the death also entitled them to separate moral compensation, despite the fact that
they had received blood money.
When deciding the final compensation amounts, the courts take into account multiple factors such as
the degrees of negligence, contributory fault and the road conduct of both the victim and the
accused. The motorist’s vehicle was insured by the insurance company, so by law, they were
responsible for claims. The court therefore granted a compensation package that would compensate for
the loss of earnings by the family’s sole breadwinner, as well as moral damages suffered by the
surviving family members.
Conclusion
This landmark case is a clear illustration of the UAE courts’ protection of families, affected by
fatal traffic accidents. The Dh496,429 award notably included the civil damages in addition to the
statutory blood money, establishing a precedent for comprehensive
compensation claims. Families who lose their sole breadwinner can pursue, the rightful
compensation despite initial insurance company resistance. The fact is, there is still a need for
competent legal representation, to negotiate complex claims, and secure financial benefits for
bereaved dependents, faced with sudden economic hardship.
If both parties are at fault in a Dubai accident, generally
each driver’s insurance will pay for their own vehicle repairs. With third-party
insurance, you will not be compensated for damage to your own vehicle because
this type of insurance covers only damage you cause to others. But if the other
party has full coverage, your damages may be partially paid by the other party’s
insurer depending upon the percentage of fault assigned by police.
The UAE courts award damages which include compensation for
blood money (Diya) and civil damages. The standard blood money amount is AED
200,000 for fatal accidents, but judges can award considerably more in terms of
loss of income, emotional suffering and the role of the victim as a breadwinner.
“The total compensation could be up to AED 500,000 or even more, depending on
the situation and how much the family depended on the deceased for financial
support.
First, make sure everyone is safe, and check for injuries.
Minor accidents Call Dubai Police (999) or use Dubai Police app. If you can do
so safely, take pictures of the scene and call your insurance provider within 24
hours. Obtain the official police accident report, which will assign fault and
will be needed for any insurance claims or legal actions.
An insurance company may at first refuse a claim, but UAE
law says they have to pay out a valid claim within a reasonable time. If your
claim is rejected, you can lodge a complaint with the Central Bank’s SANADAK
dispute resolution center, which offers free adjudication. Usually, courts’
rulings favor policyholders when insurers fail to comply with their legal
obligations under Federal Decree-Law No. 48/2023.
Third party insurance covers, damage you cause to other
people, and vehicles, but not your own. If you get into an accident and are at
fault or half at fault, third party insurance will not pay to fix your car. If
you have full coverage, you are covered no matter who is at fault. It is more
expensive but safer. Also if you have a newer or more expensive car, it is
really important.
