This article explores the key aspects of Copyrights, Trademarks, and Patents in the UAE, highlighting the importance of these protections and the mechanisms in place for their registration, enforcement, and penalties for violations.
Intellectual property rights are protected in the UAE through a set of federal laws. While intellectual property consists of a broad-spectrum of rights, including trademarks, copyright, patents, designs, geographical indication, utility, etc., in this article, we are focusing on the law surrounding patents. The law regulating patents in the UAE is the Federal Law No 11 of 2021 (Patents Law). It repealed the previously existing law on patents, called the Federal Law No. 17 of 2002.
Trademarks essentially constitute a reliable mechanism through which the proprietors can attract and maintain their customer base.
The UAE has recently issued the Federal Law no. 11 of 2021 concerning the regulation and protection of industrial property rights (‘ the new patents law’). The new patents law has repealed the previous act (Federal Law No. 31 of 2016).
Intellectual property covers any original ideas, designs, discoveries, inventions and creative work produced by an individual or group. Copyright, trademark, patent and design are a few of the most common types of IP protection.
Intellectual property in the wider context is beneficial for the world as it encourages innovation and development. Without allowing intellectual property rights, the individuals would not be allowed to reap the benefits of the inventions and lead on to further research and development.
It is interesting to note that patent infringement in the UAE allows for a variety of legal remedies, including criminal, civil claims as well as commercial claims.
