The Ministry of Human Resources and Emiratisation (MOHRE) has been permitted to take the decisions over the individual’s employment disputes. This significant change was established through Federal Decree-Law No. 20 of 2023. This article will discuss the new amendments and their implications for both employers and employees in the UAE.

Article 54 of the recent labour law amendments state that the employees can initiate disputes before the Ministry of Human Resources and Emiratisation (MoHRE) and such entity plays a major role in settling the dispute amicably between both parties. It emphasizes and encourages amicable resolution through MoHRE.

MOHRE tries to reach an amicable settlement to avoid legal interventions and possible lengthy and expensive court battles by resolving disputes between employers and workers. MOHRE is permitted to give the final decision in disputes where the maximum amount in the claim is capped at AED 50,000. This allows MOHRE to take on an impressive number of disputes regarding this subject matter.
Further, If the disputed parties wish to challenge the decision made by MOHRE, the parties have the right to file an appeal to the competent court within 15 working days. However, the appeals must be filed according to a timeline, the Court will review the merit of the appeal and will make the decision on the subject matter.
The Ministry of Labour may act as a guarantee in terms of all legitimate interests during the dispute proceeding and resolution process, including obliging the employer to continue paying the salaries.
In conclusion: Therefore, it would be essential to know about the amended provisions and comply with them accordingly in order to solve the disputes effectively.
